{"id":5658,"date":"2023-03-13T17:02:35","date_gmt":"2023-03-13T21:02:35","guid":{"rendered":"https:\/\/morgancountyusa.org\/?p=5658"},"modified":"2023-03-13T17:23:37","modified_gmt":"2023-03-13T21:23:37","slug":"west-virginia-refuses-to-make-public-cacapon-state-park-bids","status":"publish","type":"post","link":"https:\/\/morgancountyusa.org\/?p=5658","title":{"rendered":"West Virginia Refuses to Make Public Cacapon State Park Bids"},"content":{"rendered":"\n<p>The state of West Virginia is refusing to release bids received for developing the proposed RV Camp and recreational facility at Cacapon State Park in Berkeley Springs, West Virginia.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><a href=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/cacapon-4.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/cacapon-4.jpg\" alt=\"\" class=\"wp-image-5659\" width=\"342\" height=\"180\" srcset=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/cacapon-4.jpg 680w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/cacapon-4-300x158.jpg 300w\" sizes=\"auto, (max-width: 342px) 100vw, 342px\" \/><\/a><\/figure>\n<\/div>\n\n\n<p>The refusal comes despite the fact that the state\u2019s request for proposals (RFP) explicitly states that \u201cproposal submissions become public and are available for review immediately after opening.\u201d&nbsp;<\/p>\n\n\n\n<p>At least two requests have been made to the state to see the bids.<\/p>\n\n\n\n<p>One was made on March 2, 2023 by Morgan County resident Scott DuBoff to the West Virginia Division of Natural Resources (DNR).&nbsp;<\/p>\n\n\n\n<p>The Division\u2019s Deputy Director Wendy Greene responded on March 6 denying DuBoff\u2019s request saying that \u201cthe records requested are not public records subject to disclosure under the Freedom of Information Act until there has been an award of the contract.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cAfter the issuance of an award, you may submit a request for the desired records and the Division will be happy to process that request,\u201d Greene wrote.<\/p>\n\n\n\n<p>DuBoff says that Greene is clearly wrong.<\/p>\n\n\n\n<p>DuBoff wrote back to Greene saying that the RFP states in the clearest of terms that \u201cproposal submissions become public and are available for review immediately after opening.\u201d<\/p>\n\n\n\n<p>Then on March 6, <em>Morgan County USA<\/em> sent a Freedom of Information Act request to the West Virginia Department of Commerce asking to see the handful of bids that were submitted.<\/p>\n\n\n\n<p>Today, we received a letter from Graham Platz, the Department of Commerce\u2019s general counsel.<\/p>\n\n\n\n<p>\u201cBecause of the size and the scope of your FOIA request,\u201d Platz wrote, \u201cthe Department\u2019s search for and review of documents remains ongoing. The Department anticipates completing its review and responding to your request on or before March 24, 2023.\u201d<\/p>\n\n\n\n<p><em>Morgan County USA <\/em>also asked Blue Water, the front runner in the race to develop the RV and recreational facilities at Cacapon, to make public their bid.&nbsp;<\/p>\n\n\n\n<p>\u201cOur submission is the property of the State Park,\u201d wrote Emily Demarco of Blue Water.&nbsp; \u201cHopefully, when they award it, you will be able to get a copy of it.\u201d<\/p>\n\n\n\n<p>So, everybody appears to be on the same page here.<\/p>\n\n\n\n<p>The state says in its RFP that the bids are public when submitted.<\/p>\n\n\n\n<p>The bids are submitted.<\/p>\n\n\n\n<p>And the bids are not made public.<\/p>\n\n\n\n<p>What\u2019s going on?<\/p>\n\n\n\n<p>There is real left\/right opposition to the 250 site RV camp and recreational facility.<\/p>\n\n\n\n<p>The letters pages of the <em>Morgan Messenger<\/em> recently have featured letters in opposition, including from former Cacapon State Park superintendent Tom Ambrose who wrote that \u201cparks were never intended to be major profit centers.\u201d<\/p>\n\n\n\n<p>A recent County Commission meeting was packed with citizens waiting to speak in opposition.<\/p>\n\n\n\n<p>Clearly, the state does not want to release the details of the bids before they are finalized because if they are made public, the state fears that the already brewing opposition will grow.<\/p>\n\n\n\n<p>So even though the law says the bids must be made public upon opening, the state isn\u2019t going to make them public.<\/p>\n\n\n\n<p>It\u2019s now clear that no one in the state park system wants this massive RV camp and recreational development.\u00a0<\/p>\n\n\n\n<p>Then why is it happening?&nbsp;<\/p>\n\n\n\n<p>\u201cIt\u2019s coming from upstairs,\u201d we are told.<\/p>\n\n\n\n<p>Let\u2019s do a quick five line tour of <em>Civics 101.<\/em><\/p>\n\n\n\n<p>We live in an upstairs\/downstairs society.<\/p>\n\n\n\n<p>Downstairs is you and me.&nbsp;<\/p>\n\n\n\n<p>What we ask for doesn\u2019t matter.&nbsp;<\/p>\n\n\n\n<p>The law be damned.<\/p>\n\n\n\n<p>Upstairs is calling the shots.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The state of West Virginia is refusing to release bids received for developing the proposed RV Camp and recreational facility at Cacapon State Park in Berkeley Springs, West Virginia.
