{"id":3418,"date":"2018-05-03T17:14:43","date_gmt":"2018-05-03T21:14:43","guid":{"rendered":"https:\/\/morgancountyusa.org\/?p=3418"},"modified":"2018-05-03T17:30:42","modified_gmt":"2018-05-03T21:30:42","slug":"judge-refusal-to-rule-on-residency-keeps-reed-on-the-may-8-primary-ballot-a-state-court-judge-in-charleston-west-virginia-ruled-today-that-tally-reed-will-remain-on-the-may-8-republican-primary-bal","status":"publish","type":"post","link":"https:\/\/morgancountyusa.org\/?p=3418","title":{"rendered":"Judge&#8217;s Refusal to Explore Residency Keeps Tally Reed on the May 8 Primary Ballot"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A state court judge in Charleston, West Virginia ruled today that Republican House of Delegates candidate Tally Reed will remain on the May 8 primary ballot.<\/span><\/p>\n<div id=\"attachment_3415\" style=\"width: 310px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3415\" class=\"size-medium wp-image-3415\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/reeds-1-300x169.jpg\" alt=\"\" width=\"300\" height=\"169\" srcset=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/reeds-1-300x169.jpg 300w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/reeds-1-768x431.jpg 768w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/reeds-1-1024x575.jpg 1024w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/reeds-1.jpg 1134w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-3415\" class=\"wp-caption-text\">Ken and Tally Reed in Circuit Court in Charleston<br \/>(Photo Credit: Public News Service)<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Circuit Court Judge Joanna Tabit said she would not even consider arguments made by residents of the 59th House of Delegates district that Reed does not live where she claims she lives because the petition was filed after early voting had started.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhy not resolve it after the election?\u201d Judge Tabit asked attorney Patrick Lane, who brought the lawsuit on behalf of the residents. \u201cIf there is an issue with respect to residency, it can be resolved then.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lane said to decide after the primary is to disenfranchise the primary voters.<\/span><\/p>\n<div id=\"attachment_3416\" style=\"width: 235px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3416\" class=\"size-medium wp-image-3416\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/tabit-1-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" srcset=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/tabit-1-225x300.jpg 225w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/tabit-1.jpg 300w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><p id=\"caption-attachment-3416\" class=\"wp-caption-text\">Circuit Court Judge Joanna Tabit<\/p><\/div>\n<p><span style=\"font-weight: 400;\">\u201cWhat about the voters who have already voted?\u201d Judge Tabit asked Lane.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe want to make sure that those voters in the primary are casting for an eligible candidate,\u201d Lane said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIf Ms. Reed were to win the primary, and then after the primary she is determined to be ineligible, it is not the voters who choose who that replacement is. It is the executive committee of the Republican Party in that district.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But the Judge ruled that because of early voting, because hundreds of people have already voted in the May 8 Republican primary, she can\u2019t even look at the question of whether Tally Reed is a resident of the district. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The petition was filed too late \u2013 people have already voted, the Judge ruled.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lane said that there were complaints made to the Secretary of State\u2019s office during as early as February of this year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But an attorney for the Secretary of State said that April 16 was when the complaints were first filed with the Secretary of State \u2013 not earlier in the year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lane countered that he has copies of complaints filed with the Secretary of State as early as February.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Judge said she was not deciding the residency issue. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn my view, that leaves you an avenue to challenge post-election if deemed appropriate,\u201d the Judge told Lane.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cI am thankful and relieved that the Kanawha County Circuit Court agreed with our position to dismiss this matter,\u201d Tally Reed said in a statement. \u201cWe look forward to putting this distraction behind us and finishing strong in these days leading up to the primary election as we spread our pro-jobs message to the voters of the 59th Delegate District.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But the case will probably drag on through the election year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Secretary of State has until June to decide whether there is enough evidence to bring a criminal case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And Delegate Mike Folk (R-Berkeley), who has been driving the challenge to Reed, said that the petitioners are considering an appeal to the West Virginia Supreme Court either Friday or Monday.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Supreme Court called on the Circuit Court to \u2018establish a proper record,\u2019\u201d Folk said. \u201cThis judge made up her mind coming into the hearing that she wasn\u2019t going to do that.
