{"id":3137,"date":"2018-01-16T16:50:02","date_gmt":"2018-01-16T21:50:02","guid":{"rendered":"https:\/\/morgancountyusa.org\/?p=3137"},"modified":"2018-01-16T17:01:22","modified_gmt":"2018-01-16T22:01:22","slug":"senator-charles-trump-and-the-west-virginia-legislative-drive-to-cheat-workers-and-consumers","status":"publish","type":"post","link":"https:\/\/morgancountyusa.org\/?p=3137","title":{"rendered":"Senator Charles Trump and the West Virginia Legislative Drive to Cheat Workers and Consumers"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Senator Charles Trump (R-Morgan), the chairman of the West Virginia Senate Judiciary Committee, is leading the charge in the state legislature to help corporations cheat workers and consumers &#8212; and to make getting caught a mere cost of doing business.<\/span><\/p>\n<div id=\"attachment_3136\" style=\"width: 310px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3136\" class=\"size-medium wp-image-3136\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/trump-2-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/trump-2-300x200.jpg 300w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/trump-2-768x512.jpg 768w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/trump-2-1024x683.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-3136\" class=\"wp-caption-text\">Senator Charles Trump<br \/>(R-Morgan County)<\/p><\/div>\n<p><span style=\"font-weight: 400;\">That\u2019s according to Martinsburg attorney Garry Geffert. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Geffert should know. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Geffert represents workers and consumers against corporations who are trying to cheat them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cTime was that if a consumer told a debt collector she was represented by an attorney, and told the debt collector how to contact the attorney, the West Virginia law required the debt collector to deal only with the attorney,\u201d Geffert told Morgan County USA. \u201cNo more. Thanks to Senator Trump, beginning in 2015 the consumer had to send or fax a letter to the registered agent or the central office of the debt collector.\u201d <em>[Senator Trump sponsored the legislation \u2013 <a href=\"http:\/\/www.wvlegislature.gov\/Bill_Status\/Bills_history.cfm?input=542&amp;year=2015&amp;sessiontype=RS&amp;btype=bill\">SB 542 \u2013 that was passed into law in 2015<\/a>.]<\/em><\/span><\/p>\n<div id=\"attachment_3138\" style=\"width: 310px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3138\" class=\"size-medium wp-image-3138\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/garry-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/garry-300x225.jpg 300w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/garry-768x576.jpg 768w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/garry.jpg 1000w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-3138\" class=\"wp-caption-text\">Garry Geffert<br \/>Martinsburg, West Virginia<\/p><\/div>\n<p><span style=\"font-weight: 400;\">\u201cThen, the debt collector only has to stop harassing if it actually receives the letter, and then has three more days after receiving the letter to harass the consumer \u2013 even if the consumer does not actually owe the money,\u201d Geffert said. \u201cHowever, the letter requirement apparently did not achieve the goal of letting abusive debt collectors to keep abusing.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSo, in 2017, Senator Trump helped change the requirement so that the notice of representation had to be sent by certified mail.\u201d <em>[Senator Trump was <a href=\"http:\/\/www.wvlegislature.gov\/Bill_Status\/bills_history.cfm?INPUT=563&amp;year=2017&amp;sessiontype=RS\">the original sponsor of the legislation \u2013 SB 563<\/a> \u2013 that was passed into law in 2017.]<\/em><\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIf a debt collector continues to illegally harass a consumer, or if a newly bought used car blows up, the procedure to obtain relief is long and cumbersome,\u201d Geffert explained. \u201cAs a result of Senator Trump\u2019s legislative work, since 2015 a consumer who has been illegally harassed or ripped off cannot simply sue the bum.\u201d \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFirst, the consumer must send a letter by certified mail, return receipt requested, to the rip-off artist\u2019s registered agent or, if there is none, to its principal place of business. The letter not only has to give the factual basis for the claim, but has to tell the rip-off artist that it has 45 days after receipt of the letter to propose a cure.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIf the consumer accepts the cure offered by the rip-off artist, the rip-off artist has another 20 days to begin \u2013 not complete, just begin \u2013 the cure. If the cure is not acceptable \u2013 and if the letter sent by the consumer contains all the requirements of the new law \u2013 only then can the consumer file a lawsuit. \u00a0And, if the consumer needs a lawyer, other provisions enacted by Senator Trump and his allies will allow the rip-off artist not only to delay making reparations for over two months, but to make the consumer absorb his legal fees.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis is contrary to consumer protection laws in most states, and to federal consumer protection laws, most of which require a business to pay the fees of the consumer\u2019s lawyer when the consumer wins the case.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Geffert said that this \u201cconvoluted procedure\u201d is in direct contrast to the procedure a bank uses to foreclose on a home.<\/span><\/p>\n<p><em><span style=\"font-weight: 400;\">[Senator Trump has been <a href=\"https:\/\/www.reuters.com\/finance\/stocks\/company-officers\/CBFC.PK\">chairman of the board of CNB Financial Services<\/a> for the past ten years.]<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">\u201cTo foreclose, a bank only has to send a notice by certified mail directed to the owner and place a couple of ads in the back of newspaper,\u201d Geffert said. \u201cIt does not matter whether the owner actually receives the notice \u2013 all that matters is that the notice was mailed. \u00a0The foreclosure sale can take place as little as twenty days after the notice was mailed by the bank.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIf Senator Trump and his friends have their way, things will get even worse for workers,\u201d Geffert said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<a href=\"http:\/\/www.wvlegislature.gov\/Bill_Status\/bills_history.cfm?INPUT=7&amp;year=2018&amp;sessiontype=RS\">Senate Bill 7, for which Mr. Trump is a primary sponsor<\/a>, would make it much more difficult for a worker to recover wages an employer has refused to pay,\u201d Geffert said. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cA worker who did not get what he earned would have to follow the same procedure as is now required for a consumer who has been cheated. The certified letter must tell the employer both the facts for the unpaid wage claim and tell the employer it has 20 days to offer a cure. \u00a0If the employer agrees to pay, it has another 20 days to pay the wages due.\u201d \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSenator Trump will allow employers to avoid paying a worker his wages for nearly a month a half before a suit can be filed.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBut all this might still get worse,\u201d Geffert said. \u201c<a href=\"http:\/\/www.wvlegislature.gov\/Bill_Status\/bills_history.cfm?INPUT=35&amp;year=2018&amp;sessiontype=RS\">Senate Bill 35<\/a>, which has been referred to the Judiciary Committee chaired by Senator Trump, would require a worker or consumer to go through an expensive mediation process before filing any lawsuit.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe person who has been cheated would be required to send a certified mail, return receipt requested demand for mediation. The demand would have to tell bad business the \u2018specific nature\u2019 of the claim, and tell the bad business that it has 20 days from receipt of the notice to respond. Then another ten working days are allowed to agree on a mediator. \u00a0Mediation can be delayed up to 90 days. Then each side must pay half of what the mediator charges, and mediators are not cheap.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOnly if mediation fails, or the bad business just does not respond, can a lawsuit be brought. While SB 35 says this is meant to encourage voluntary resolution of disputes, its real intent is clear \u2013 to make it more difficult and expensive to sue bad businesses who have refused to pay wages or who have ripped off consumers.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Geffert says that in his forty years of representing workers and consumers \u201cI have found that when honest employers or honest business people make a mistake, they quickly correct it without litigation or mediation.\u201d \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSometimes, there are good faith disputes which lead to litigation. Almost all of those settle, many of them through voluntary or court-ordered mediation conducted after each side has had an opportunity to learn the other sides position through processes governed my court rules.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFor honest employers and business people, the changes in law which Senator Trump has enacted or proposed do nothing, except add delay and expense.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBut my forty years of work have also taught me that there is a class of employers who will do most anything, and pay lawyers almost any amount, to avoid paying their workers minimal wages or to continue a dishonest business practice. This is especially so if the workers or consumers have dark skin or are female.
