{"id":2756,"date":"2017-02-21T12:56:26","date_gmt":"2017-02-21T17:56:26","guid":{"rendered":"https:\/\/morgancountyusa.org\/?p=2756"},"modified":"2017-02-21T13:13:58","modified_gmt":"2017-02-21T18:13:58","slug":"craig-blair-right-to-trespass-forced-pooling-and-out-of-state-corporations","status":"publish","type":"post","link":"https:\/\/morgancountyusa.org\/?p=2756","title":{"rendered":"Craig Blair Right to Trespass Forced Pooling and Out of State Corporations"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">West Virginia Senator Craig Blair (R-Berkeley County) is sponsoring legislation backed by out of state corporations who funded his campaigns.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-2757\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/fracking-1-300x261.jpg\" alt=\"fracking\" width=\"300\" height=\"261\" srcset=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/fracking-1-300x261.jpg 300w, https:\/\/morgancountyusa.org\/wp-content\/uploads\/fracking-1.jpg 625w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">In particular, Blair is the lead sponsor on legislation (SB 245) that would give gas pipeline companies the right to trespass on private property, an issue close to the hearts of many of his constituents who are fighting off the Tulsa, Oklahoma based IGS Utilities Mountaineer Gas pipeline that would cut through prime farmland in Morgan and Berkeley counties.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Blair is also the lead sponsor on SB 244, a bill that would allow gas drillers to force owners of gas reserves to allow horizontal drilling through their property, even if the owners do not want to sell their gas. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Why would a property rights defender like Blair sponsor legislation that would give giant out of state multinationals the right to trespass on his constituents&#8217; property?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s go to the videotape.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Or in this case, <a href=\"https:\/\/cfrs.wvsos.com\/#\/election_list\/-2\/3394\/en?mode=candidate\">the West Virginia Secretary of State\u2019s Campaign Finance Reporting System.<\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">When Blair ran for Senate in 2012, he raised a mere $7,556.65.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But he proved himself to the giant out of state fossil fuel corporations, and in his 2016 run, the companies stepped up and helped crank his 2016 haul to $47,032.75.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Much of that came from fossil fuel company political action committees.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Who are these companies, where are they from, and what do they do?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">American Electric Power is a major electrical utility based in Columbus, Ohio. AEP owns Appalachian Power, which operates in West Virginia.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">FirstEnergy is an energy utility based in Akron, Ohio. FirstEnergy operates in West Virginia through Mon Power and Potomac Edison.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">EQT Production is the Pittsburgh, Pennsylvania based natural gas fracking giant. \u00a0Seventy-eight percent of the company\u2019s total proved reserves are located in the Marcellus shale region of the Appalachian basin.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dominion Energy is the Richmond, Virginia based energy company that delivers natural gas to West Virginia.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Marathon Petroleum is the Findlay, Ohio based petroleum refining, marketing and transportation company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alpha Natural Resources in the Kingsport, Tennessee based coal company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Williams Companies is a Tulsa, Oklahoma based natural gas processing and transportation company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And Exxon Mobil is the the Irving, Texas based oil and gas multinational giant.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bills Blair is sponsoring &#8212; SB 244 and SB 245 &#8212; are supported by his corporate funders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">SB 244 would allow gas drillers to force owners of gas reserves to allow horizontal drilling through their property, even if the owners do not want to sell their gas. If 51 percent of mineral owners in a &#8220;pool&#8221; consent to a lease, gas companies could take the gas from the other 49 percent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">SB 245 allows gas industry surveyors to trespass on a landowner&#8217;s property without permission. It overturns a WV Supreme Court ruling last year upholding property owner&#8217;s rights to determine who comes on their land and rejecting eminent domain claims by pipeline companies. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">SB 245 allows private companies to take your private property for private gain. <\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>West Virginia Senator Craig Blair (R-Berkeley County) is sponsoring legislation backed by out of state corporations who funded his campaigns.
