{"id":2632,"date":"2016-11-09T10:48:11","date_gmt":"2016-11-09T15:48:11","guid":{"rendered":"https:\/\/morgancountyusa.org\/?p=2632"},"modified":"2016-11-09T10:48:11","modified_gmt":"2016-11-09T15:48:11","slug":"when-a-building-debris-dump-appears-and-the-county-isnt-told-about-it","status":"publish","type":"post","link":"https:\/\/morgancountyusa.org\/?p=2632","title":{"rendered":"When a Building Debris Dump Appears and the County Isn\u2019t Told About It"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A building debris dump appears in the county &#8212; right next to a church.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">County officials are not notified.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-2633\" src=\"https:\/\/morgancountyusa.org\/wp-content\/uploads\/reclaim.png\" alt=\"reclaim\" width=\"261\" height=\"191\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Neighbors are not notified.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There is no public notice in the local newspaper. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Can it happen here in Morgan County?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Why not? <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It just happened in neighboring Hampshire County.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A building demolition firm, <a href=\"http:\/\/www.reclaimcowv.com\/\">Reclaim Company LLC<\/a>, based in Fairmont, West Virginia and Catonsville, Maryland, opened a dump site on Cooper Mountain in Hampshire County earlier this year without alerting county officials. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The dump is located next to the New Testament Faith Assembly in Capon Bridge.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In November 2015, the company did get a non-commercial construction demolition permit from the West Virginia Department of Environmental Protection.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This did not at all please Charles Baker of the Hampshire County Planning Office.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Baker said he learned about the facility only a couple of months ago when he got calls from neighboring residents complaining about traffic in the area.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In September, Baker wrote to state officials questioning how the permit could be issued without first notifying \u201cadjoining property owners, local communities, or the local governmental body having jurisdiction.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Baker also questioned how the permit was non-commercial when in fact Reclaim Inc. is a for-profit company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIf a developer is demolishing homes in one location and then transporting the debris so that they may redevelop the original property for profit or has a demolition business, wouldn\u2019t that be a for-profit venture?\u201d Baker asked.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">West Virginia Department of Environmental Protection official Scott Mandirola wrote back to Baker confirming that registrations with the state for a dump site \u201care not subject to public notice or public comment.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So, yes &#8212; a company can buy a parcel of land anywhere in Morgan County, get a permit from the state, and just start dumping.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No notice to you. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">No notice to me.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No notice in the local newspaper.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No notice to anyone in the local community.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Reclaim\u2019s CEO RJ Williams said that the company purchased about 70 acres in Hampshire County in 2014, got their state permit from the Department of Environmental Protection in November 2015 and began dumping at the site in May 2015. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Of the 70 acres, less than two acres are permitted for the dump site, Williams said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Williams said that the only thing being dumped there is construction demolition debris \u2013 concrete, brick, wood. drywall \u2013 no asbestos or hazardous materials will be dumped there.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe have very strict guidelines that we have to follow,\u201d Williams said. \u201cWe have four dump sites around the state and have had zero notices of violations. I have no incentive to take hazardous materials out there. We follow the rules and guidelines set by the state. We may only use the Hampshire County site four or five times out of the year. It\u2019s not a staffed facility. We only staff it when we are there doing something.
